Agreement to Terms

By accessing or using Gymlab, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Service.

Description of Service

Gymlab is an AI-powered fitness application that provides:

• Personalized workout plan generation using artificial intelligence
• An AI coach you can chat with by text, photo, or voice input
• Exercise tracking and progress monitoring, including heart rate from an Apple Watch or a connected heart-rate monitor
• Exercise demonstration videos and instructions
• Fitness preference management and goal setting
• Communities, where you can share workouts, records, and messages with other members
• Optional connections to Apple Health, other fitness apps, and AI assistants you authorize

User Accounts

Account Creation

To use the Service, you must create an account. You sign in with a one-time code sent to your email address, with Sign in with Apple, or with your Google account; Gymlab does not use passwords. When you create an account you provide:

• A valid email address, or an Apple or Google account
• Your year of birth, to confirm that you meet the minimum age
• Optional: Your name and fitness preferences

You must be at least 17 years old to use Gymlab.

Account Security

You are responsible for:

• Keeping access to your email account, your Apple or Google account, and your devices secure
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful content
• Scrape, data mine, or extract data using automated means
• Impersonate others or provide false information
• Share your account credentials with others
• Reverse engineer or attempt to extract source code from our Service
• Harass, threaten, or abuse other members, or post content that breaks the Community rules below

Communities

Communities let you share workouts, personal records, training load, messages, and photos with other members of a group or gym. Joining a community is your choice. When you join, the sharing settings you agree to decide what other members can see, and some communities require certain sharing to take part. The Privacy Policy describes what members can see.

Community Rules

You are responsible for what you post. You agree not to post content that:

• Is unlawful, harassing, threatening, hateful, or discriminatory
• Is sexually explicit or violent
• Infringes anyone's intellectual property, privacy, or other rights
• Shares another person's personal information without their permission
• Is spam, advertising, or misleading
• Gives dangerous health, medical, or training advice

Moderation and Reporting

Community owners and admins can remove messages and members from their community. We may remove any content, and suspend or terminate any account, that breaks these rules. To report content or a member, email [email protected] with the community name and a description of the problem. We review reports promptly.

Health and Fitness Disclaimer

• Consult Your Doctor: Always consult with a healthcare professional before starting any new exercise program, especially if you have pre-existing health conditions.
• Not Medical Advice: Gymlab provides fitness guidance powered by AI but is NOT a substitute for professional medical advice, diagnosis, or treatment.
• Use at Your Own Risk: You acknowledge that physical exercise carries inherent risks of injury. You assume all risks and hazards associated with using our workout programs.
• Listen to Your Body: Stop exercising immediately if you experience pain, dizziness, or discomfort and seek medical attention if necessary.
• AI Limitations: While our AI provides personalized recommendations, it cannot assess your individual medical condition or physical capabilities.

Intellectual Property

Our Content

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, software, and AI-generated workout plans, are owned by Gymlab or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any content you submit to the Service (workout logs, preferences, messages, photos, etc.). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content to provide and improve our Service, including showing content you share in a community to that community's members.

We may also use workout plans generated in Gymlab to create de-identified example plans that we publish on our website. Before publication we remove any details that could identify you, and an administrator reviews every example plan. The Privacy Policy explains how to ask us to exclude your plans.

Third-Party Services

Our Service integrates with third-party services including:

• AI service providers for workout generation, chat coaching, voice-input transcription, and analysis of exercise videos you share
• An exercise video search provider that finds demonstration videos from public sources such as YouTube
• An authentication provider for sign-in and account security
• A maps and places provider for finding gyms
• Services you choose to connect, such as Apple Health, the Hevy workout app, and AI assistants you authorize to access your Gymlab data

The categories of third parties we share your data with, and how they process it, are described in our Privacy Policy. These third-party services have their own terms and privacy policies. We are not responsible for the practices of these third parties.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Gymlab and its affiliates, officers, employees, agents, and licensors SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from your use or inability to use the Service.
• We SHALL NOT BE LIABLE for any personal injury, including death, caused by your use or misuse of the Service or following our workout programs.
• Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of AI-generated workout plans
• Warranties that defects will be corrected

Indemnification

You agree to indemnify, defend, and hold harmless Gymlab, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any injury or harm resulting from your use of our workout programs

Changes to Service

We reserve the right to:

• Modify or discontinue any part of the Service at any time
• Change pricing or introduce new fees with reasonable notice
• Update features, functionality, or AI models

We will make reasonable efforts to notify you of significant changes.

Changes to Terms

We may revise these Terms at any time by posting the updated version on this page. By continuing to use the Service after such changes take effect, you agree to be bound by the revised Terms.

Account Termination

Your Right to Terminate

You may delete your account at any time through the app settings or by contacting us at [email protected]. Upon deletion:

• Your account and personal data will be deleted as described in the Privacy Policy
• All workout history, preferences, and community messages will be permanently removed
• A subscription bought on the web is cancelled immediately, without an automatic refund for the rest of the billing period, subject to any refund rights you have under applicable law
• A subscription bought through the App Store is not cancelled automatically; cancel it in your Apple account's subscription settings

Our Right to Terminate

We may suspend or terminate your account immediately if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse the service or harm other users
• Fail to pay for any paid services

Subscriptions, Refunds and Cancellation

You can create an account, complete onboarding, and receive your first plan without paying. Starting workouts and chatting with your coach after onboarding require a paid Gymlab subscription. We offer monthly and annual subscriptions, at the prices shown in the app before you buy.

• Free trial: Where offered, a free trial is available once per account. Unless you cancel in time, your subscription starts and you are charged at the end of the trial. To avoid being charged, cancel an App Store trial at least 24 hours before it ends, and a web trial before the end time shown in your subscription settings.
• Automatic renewal: Subscriptions renew automatically at the end of each billing period until you cancel.
• App Store subscriptions: Subscriptions bought in the iPhone app are sold and billed by Apple. Manage or cancel them in your Apple account's subscription settings. Refunds are handled by Apple under its policies.
• Web subscriptions: Subscriptions bought on the web are billed by our payment processor. You can cancel from the subscription settings in the web app, and cancellation takes effect at the end of your current billing period.
• Except where required by law, we do not provide refunds for partial billing periods or unused portions of a web subscription. We may offer refunds on a case-by-case basis.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be filed exclusively in the state or federal courts located in Delaware, and you hereby consent and submit to the personal jurisdiction of such courts.

Dispute Resolution and Arbitration

Informal Resolution

Before filing any claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

• The arbitration will be conducted in Delaware or remotely via videoconference
• Each party will bear its own costs and fees
• The arbitrator's decision will be final and binding
• You waive your right to participate in class action lawsuits or class-wide arbitration

Exceptions

Either party may bring a lawsuit in court for:

• Intellectual property infringement claims
• Small claims court actions (if eligible)
• Injunctive or equitable relief

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
